General Terms and Conditions



1. Validity
The following general terms and conditions apply to the business relations and transactions between HOLOGRAM and their customers at the time of transaction. Contrary conditions or terms of the client are not recognised unless HOLOGRAM gives exceptional and specific written consent.

2. Withdrawal from contract
HOLOGRAM reserves the right to withdraw from the contract of sale in the case of errors of description, printing errors or calculation errors.

3. Delivery
The ordered goods will be sent from HOLOGRAM stores to the address as supplied by the customer. Liability for the delivery is transferred to the customer as soon as the goods have left HOLOGRAM’s premises. Information concerning expected delivery times are not binding except where HOLOGRAM has given explicit written notice to the customer regarding delivery.

4. Reservation Of Ownership
The delivered goods remain the property of HOLOGRAM until all demands have been fulfilled in total by the customer.

5. Maturity and Default
The amount of the order is due immediately on delivery. For delivery to addresses within Switzerland the sum can be paid by money transfer only. For deliveries to addresses outside Switzerland payment can be made by credit card (VISA or Mastercard) or by money transfer.

6. Setoff of payment and detainment
The customer is entitled to set off payment if and when his counterclaim is legally binding or has been accepted by HOLOGRAM. The customer is entitled to make use of his right of detainment only if his counterclaim concerns the same contract of sale.

7. Warranty
Correctly ordered and delivered goods may not be returned or exchanged. The guarantee for goods which are proven on receipt to be faulty, is 6 months, to be calculated from the date of transfer of liability. Any possible faults are to be reported to HOLOGRAM without delay. Should a fault on the part of HOLOGRAM be found, then HOLOGRAM shall be obliged to correct the fault or supply a replacement. If this is not possible, or if HOLOGRAM is not willing or able to carry out the corrections, then the customer is entitled to annul the contract of sale or to demand a suitable reduction of the price.

8. Liability
- HOLOGRAM is liable for damages resulting from the absence of certain guaranteed services or for damages resulting from intent or gross negligence.
- Liability for further damages resulting from default on the part of HOLOGRAM or from the violation of an obligation, which are of particular importance to the completion of the contract of sale, is limited to those damages that are typical of the normal use of the goods and as such foreseeable.
- Further liability, in particular for damages not concerning the goods directly, or for loss of earnings or other financial damages of the customer, is excepted.

9. Privacy
Personal information and addresses will be treated by HOLOGRAM with the utmost confidentiality and will not be given to third parties under any circumstances.

10. Jurisdiction
All transactions are governed by the law of Switzerland. The place of jurisdiction for all demands concerning the business transactions is Geneva. HOLOGRAM is further entitled to institute court proceedings at the place of jurisdiction of the customer.
